These terms govern use of the Direct Mail Marketplace directory, content, forms and related services.
Directory role
Direct Mail Marketplace is an information and lead-generation platform. We are not the publisher, printer or advertiser identified in a listing unless expressly stated. We do not guarantee provider availability, accuracy, pricing, quality, results or suitability.
Permitted use
You may use the site for lawful business research and genuine inquiries. You may not scrape the directory, interfere with the site, submit false information, impersonate another person or business, bypass security, or use site information for spam or unrelated solicitation.
Listings, memberships and third-party services
Unclaimed listings may be compiled from publicly available or submitted business information. Providers may select a Free Listing, Verified Provider membership or Featured Partner membership. Paid memberships provide added visibility, credibility, referral traffic opportunities and qualified lead referrals, with no per-lead fees. Verification confirms completion of our review process only; it is not an endorsement. External links lead to third-party websites that we do not control. Any transaction or contract with a provider is solely between the user and provider.
Visibility and results
Public profiles and provider links may be discoverable by search engines and other services, but membership is not sold as a promise of SEO value. We do not guarantee indexing, search rankings, referral traffic, lead volume, sales, citations or recommendations.
Intellectual property
The platform design, original text, organization and software are owned by or licensed to TMD Management Group LLC. Provider names, logos and supplied materials remain the property of their respective owners and are displayed for directory and promotional purposes.
Disclaimers and limitation
The site is provided on an “as available” basis to the fullest extent permitted by law. TMD Management Group LLC disclaims implied warranties and will not be liable for indirect, incidental, special, consequential or punitive damages arising from use of the site or a provider relationship. Any direct liability will not exceed the greater of $100 or the amount paid by the claimant to us during the preceding six months, except where law prohibits that limitation.
Indemnity
You agree to defend and indemnify TMD Management Group LLC from claims arising from your unlawful use, submitted content, misrepresentation or violation of these terms, to the extent permitted by law.
Governing law and changes
Utah law governs these terms, without regard to conflict-of-law principles. Exclusive venue lies in the state or federal courts serving the operator’s principal Utah business location, unless applicable law requires otherwise. We may update these terms prospectively by posting a new effective date.
